Gordon Caplan College Admission Scandal
On March 12, 2019, at 6:30, Gordon was arrested by the FBI, and indicted as an alleged parent participant in the 2019 college admissions bribery scandal, for conspiracy to commit mail fraud and wire fraud. The U.S. Justice Department relied in part on a number of wiretapped telephone calls in which Gordon was taped secretly.
He appeared in Manhattan federal court, and he was released on $500,000 bail with strict travel restrictions. HJe was ordered to appear in Boston federal court on April 3, 2019.
His daughter had allegedly scored 22 (out of a possible 36) on an ACT college admission test practice exam, and Caplan allegedly discussed with his co-conspirator arranging for his daughter to fraudulently receive credit for a score in the 32 range on the test.
As part of the fraud, Gordon is alleged to have arranged to have his daughter fake a learning “discrepancy”, in order for her to receive special permission to be given extended time and a separate room to take the ACT test. After obtaining it, she was allegedly permitted to take the test at a co-conspirator’s school in West Hollywood, California.
Gordon’s alleged co-conspirator, who has pled guilty, allegedly arranged for another conspirator, a bribed proctor, to “proctor” the daughter’s exam–and correct her wrong answers so that the daughter would be credited with the high score that Gordon requested.
Gordon was alleged to have paid $75,000 (set up to be tax-deductible, masked as a donation to the foundation of an alleged co-conspirator) in November and December 2018 to have two bribed proctors of the ACT test correct his daughter’s incorrect answers after she finished her exam, thereby improving her ACT test results by 10 points as she was applying to university.
It is alleged that Gordon said to the co-conspirator, as reflected in a tape of one of his wiretapped calls: “To be honest, I’m not worried about the moral issue here”

Gordon was placed on indefinite leave by Willkie Farr & Gallagher the day after he was arrested. The law firm also removed his photo and biography from its website.

A Greenwich lawyer, who will appear before a federal judge in Boston on Wednesday as part of a wide-ranging investigation into an alleged college-admission cheating scandal, will have high-profile lawyers of his own working on his behalf.
According to federal court records, Gordon Caplan will be defended by Peter Cane, a regular commentator for Court TV, and Patrick Smith, described by his law firm as “an experienced trial lawyer and strategist with a practice focused on white collar criminal defense.”
Caplan was among a number of wealthy professionals and celebrities to face a charge of conspiracy to commit mail fraud and honest services mail fraud. He will appear in court this week with other defendants, including actress Lori Loughlin of “Full House” fame and her fashion designer husband Mossimo Giannulli, snared in the cheating scandal centered on William “Rick” Singer and his test-prep business, according to federal authorities.
The initial court appearance will be held before U.S. Magistrate Mary Page Kelley.
Caplan has been released on $500,000 bond after his arrest in early March. He was accused of making a $75,000 payment to have his daughter’s answers corrected on her ACT test by a proctor who was paid off.
The probe by the FBI into illicit efforts to secure college admission spots also led to arrests of other well-known parents, including actress Felicity Huffman. The federal complaint says a college counseling and preparation business run by Singer used bribes and other techniques to change test results, fake sporting accomplishments or otherwise buy an admission into selective colleges.
Federal officials say phone calls between Caplan and Singer were taped. Caplan, the former co-chairman of the Manhattan-based international law firm Willkie Farr & Gallagher, faces a felony conviction, which would mean an automatic disbarment. The mail fraud allegation also carries a maximum sentence of 20 years in prison, and a fine of up to $250,000.
